Shouldn't we use the EGM-96 geoid model for the height instead of WGS-84 ellipsoid?
The latter is pretty inaccurate in places.

Malcolm: The actual vertical datum used for our global DB is WGS-84, chosen for convenience, not for any particular end usage. All that matters is that all seabed/riverbed heights in the DB are referenced to a single datum.

Malcolm: It is the consumer applications that will then convert those heights to another vertical datum relevant to their purpose.
Markus: More precise it is OpenSeaMap (by pre-processing) who has to convert depths into LAT. The depth data in our depth DB will be given in LAT. Therefore the renderer can use the common vertical chart datum. Of course the horizontal datum will be WGS-84.
